Terms of Service

These Terms of Service ("Terms") govern your use of execpouch.com (the "Site") and any purchase you make from EXEC LLC ("EXEC", "we", "us", "our"), an Illinois limited liability company. By using the Site or placing an order, you agree to these Terms.

1. Eligibility — 18 and over

You must be at least 18 years old to buy from us or use this Site. By placing an order you confirm that you are 18 or older and that everything you tell us is accurate. We do not knowingly sell to minors.

2. The product

EXEC pouches are a caffeinated dietary supplement. They contain no nicotine and no tobacco. Each pouch contains 100 mg of caffeine.

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease. EXEC pouches are not intended for anyone under 18, or for anyone who is pregnant, nursing, or sensitive to caffeine. If you have a medical condition or take medication, talk to your doctor before using a caffeinated product. Nothing on this Site is medical advice.

3. Orders and pricing

All orders are subject to acceptance and availability. We may refuse or cancel any order, including after an order confirmation has been sent, for reasons that include suspected fraud, an obvious pricing or description error, a quantity that looks like resale, or an address we cannot ship to. If we cancel an order you already paid for, we refund it in full.

Prices are in U.S. dollars and may change without notice. We do our best to describe our products accurately, but we do not warrant that every description, image, or price on the Site is free of error.

4. Shipping, returns, and refunds

Shipping is covered by our Shipping Policy and returns by our Return and Refund Policy. Both are part of these Terms.

5. Your account and your information

If you create an account, you are responsible for keeping your login details secure and for activity under your account. Our handling of your personal information is described in our Privacy Policy.

6. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with or disrupt the Site or its security, to scrape or harvest data from it, to transmit malicious code, or to buy our products for resale without our written permission.

7. Intellectual property

The EXEC name, logo, product designs, photography, and Site content are owned by EXEC LLC and protected by intellectual property law. You may not use them without our written permission.

8. Third-party links and services

The Site may link to or rely on third-party services, including our payment processor and email provider. We are not responsible for third-party content or practices; their own terms apply to what they do.

9. Disclaimer of warranties

Except where the law says otherwise, the Site and our products are provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, EXEC LLC and its owners, employees, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability for any claim is limited to the amount you paid for the order the claim relates to. Some states do not allow these limits, so they may not apply to you.

11. Indemnification

You agree to indemnify and hold EXEC LLC harmless from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the Site or our products.

12. Governing law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Lake County, Illinois, and you consent to that jurisdiction.

13. Changes to these Terms

We may update these Terms at any time. The version posted on this page is the version in effect. Continuing to use the Site after a change means you accept the updated Terms.
